DigiPlus Group Privacy Notice

DigiPlus Interactive Corp., its subsidiaries and affiliates recognize and value your privacy and is committed to protecting your personal data in accordance with Republic Act 10173 (Data Privacy Act of 2012), its Implementing Rules and Regulations, and other relevant issuances of the National Privacy Commission. This Privacy Notice covers most of our customer-facing activities and sets out the general terms on how we handle your personal data. More information on our privacy practices are set out in the Privacy Notices that we issue for specific personal data processing activities in our products and services.

This policy applies to DigiPlus Interactive Corp., its subsidiaries and subsidiaries of its subsidiaries, collectively known as “DigiPlus”.

We collect your personal data when you:

  1. Use any of our websites;
  2. Visit our offices, gaming outlets and other facilities;
  3. Become or apply to become one of our investors, partners, vendors, suppliers, contractors or employees;
  4. Take part in our surveys or research activities;
  5. Register as a player of any of our mobile gaming platforms;
  6. Become a customer of any of our gaming outlets;
  7. Become a member of any of our loyalty programs;
  8. Become our business/commercial/any corporate event partner;
  9. Join any of our events or promotions;
  10. Submit a request or inquiry to us.

The personal data that we collect from you may include the following:

  1. Name, age, sex, civil status, date of birth, citizenship, nationality, address, email address, phone number and mobile number;
  2. Business information and employment information;
  3. Medical information;
  4. Government issued identification numbers such as those issued by the Social Security System (SSS), Pag-IBIG, Bureau of Internal Revenue (BIR), or passport numbers;
  5. Government issued clearances such as those issued by the National Bureau of Investigation (NBI) or the Philippine National Police (PNP);
  6. Professional licenses issued by the Professional Regulation Commission (PRC);
  7. ID photos;
  8. Surveillance camera videos and images;
  9. Other personal information needed to process a request, inquiry or transaction with us or any other information that you will directly provide us.

How do we collect your personal data?

  1. When you visit our website and fill out our online contact us form;
  2. When you call us and verbally share your personal data;
  3. When you fill out manual and electronic forms to transact with us or avail of any of our services;
  4. When you submit documents containing personal data to our company;
  5. When you attend any of our events and fill out attendance sheets;
  6. When you manually or electronically register to join any of our promotions and loyalty programs;
  7. When you request that we contact you or include you in our marketing campaigns;

How we use your data?

We only use your data when there is a lawful basis to do so. This may be based on a contract, legal obligation, vital interest, public interest, legitimate interest or consent.

We use your data to:

  1. Process registrations to avail of our services;
  2. Process requests to join our membership programs;
  3. Process requests to join our marketing campaigns;
  4. Process investor, vendor, supplier, contractor or employment applications;
  5. Process investor, vendor, supplier, contractor related transactions;
  6. Abide by contractual and legal obligations;
  7. Fulfill employer-employee relationship obligations (fulltime, part-time, consultation, contractual, etc.);
  8. Respond to inquiries and requests;
  9. Enable DigiPlus to manage its business;
  10. Enforce the rights of DigiPlus before any competent authority, regulator, law enforcement agency or any judicial or quasi-judicial body;
  11. Comply with applicable laws, regulations, directives, issuances by, or agreements of the Company to any competent authority, regulator, law enforcement agency or any judicial or quasi-judicial body;
  12. Abide by or comply with directives as mandated by any of the legal bases of processing data;
  13. To enable the processing, fulfillment or perfection of a lawful engagement or obligation.

How we share or disclose your data?

We do not share or disclose your data unless there is a legal basis to do so. In transacting with DigiPlus and availing of our services we may disclose and share your personal information to the following:

  1. Any member entity of the DigiPlus group, its subsidiaries, subsidiaries of its subsidiaries, directors, officers, employees, duly authorized representatives and affiliates;
  2. Third party service providers, vendors, suppliers and contractors;
  3. Any competent authority, regulator, law enforcement agency or any judicial or quasi-judicial body;
  4. Any other entities considered necessary to carry out the services, transactions, obligations mentioned above and any other lawful purposes;

How we protect your data?

We protect your data by:

  1. Restricting access to your personal data only to authorized personnel who hold your data with strict confidentiality;
  2. Educating our employees to properly handle your personal data;
  3. Requiring third parties to protect your personal data in a manner aligned to our own security standards;
  4. Implementing physical, technical and organizational measures to protect your data from loss, theft, unauthorized access, disclosure, copying, use or modification;
  5. Storing your data in secure servers and deploying physical and digital security controls.

How we retain your personal data?

We only retain your personal data only according to operational needs and in compliance to applicable laws, rules and regulations.  Subject to applicable laws, rules and regulations, you may request for the deletion of your data within a reasonable amount of time.

Your Data Privacy Rights:

  1. You have the right to be informed that your personal data will be collected and processed;
  2. You have the right to reasonable access, upon written request, to your personal data that DigiPlus or an entity under the DigiPlus group collects or holds and the reason for such processing;
  3. You have the right to object if the processing of personal data involved is based on consent or on legitimate interest;
  4. Subject to applicable laws, rules and regulations, you have the right to suspend, withdraw or order the blocking, removal or destruction of your personal data;
  5. You have the right to claim compensation if you suffered damages due to inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of personal data, or if there are any violation of your rights and freedoms as a data subject;
  6. You have the right to file a complaint to the National Privacy Commission if any of your rights as a data subject was violated;
  7. You have the right to correct any inaccuracy or error in your personal data that DigiPlus may hold;
  8. Subject to applicable laws, rules and regulations, you have the right to obtain and electronically move, copy or transfer your data in a secure manner for further use.

DigiPlus Interactive Corp. Annual and Special Stockholders Meeting Privacy Notice

DigiPlus Interactive Corp., its subsidiaries and affiliates (collectively referred to as “DigiPlus”) is committed to protecting the privacy and ensuring the security of your personal information. This Privacy Notice aims to provide you with information regarding the collection, use, disclosure, and protection of your personal information in relation to Annual and Special Stockholders Meetings convened by DigiPlus in accordance with the Revised Corporation Code of the Philippines (Republic Act No. 11232).

This Privacy Notice shall be applicable to all participants of Annual or Special Stockholders Meetings, including stockholders, their representatives or proxies, brokers, investors, DigiPlus’ directors, officers, employees, agents and all other persons who attend.

  1. Personal Information Controller

DigiPlus Interactive Corp., located at Ecoprime Building, 32nd Street corner Ninth Avenue, Bonifacio Global City, Taguig City is the Personal Information Controller (PIC) responsible for the processing of your personal information. If you have any questions or concerns regarding the processing of your personal information, please contact our Data Protection Officer (DPO) at privacy@digiplus.com.ph.

  1. Types of Personal Information Collected

We may collect and process the following personal information related to you as an attendee of annual or special stockholders’ meeting:

  • Contact information (g., name, address, email address, telephone number);
  • Stock ownership details;
  • Identification documents (g., government-issued ID, passport);
  • Attendance records for annual and special board meetings;
  • Any other personal data necessary for the fulfillment of legal and regulatory obligations under the Revised Corporation Code of the Philippines.
  1. Purpose and Legal Basis of Processing

We collect and process your personal information for the following purposes:

For stockholders:

  • To facilitate communication and provide updates on stockholder meetings, including annual and special meetings;
  • To establish your identity as a stockholder of record in order to perform services in connection with being a stockholder, such as managing, administering, approving or facilitating any transaction or action in relation to your shares of stock, the payment of your dividends, and the registration of your shares in the stock and transfer books;
  • To perform statistical analysis to improve the timeliness and accuracy of services provided to stockholders;
  • To comply with the reportorial obligations with the Philippine Stock Exchange (PSE) and other regulatory agencies and instrumentalities of the government, including, but not limited to the Securities and Exchange Commission (SEC) and Bureau of Internal Revenue (BIR);
  • To comply with and/or to respond to legal processes or lawful orders of any judicial or quasi-judicial body;
  • To comply with other legal and regulatory obligations under the Revised Corporation Code of the Philippines;
  • To exercise and protect our rights and interests as a corporation;
  • To fulfill any other legitimate purposes identified at the time of data collection or as required by law.
  • Any other purpose analogous to the foregoing.

For other attendees:

  • For documentation of attendance;
  • To fulfill any other legitimate purposes identified at the time of data collection or as required by law;
  • To exercise and protect our rights and interests as a corporation;

The information shall be collected, processed, and stored in compliance with the Republic Act No. 10173, also known as the Data Privacy Act of 2012, with its Implementing Rules and Regulations, other relevant laws and issuances by the National Privacy Commission (NPC) and in line with DigiPlus’ privacy policies.

The legal basis for processing your personal data may include the necessity of processing for the performance of a contract, compliance with legal obligations, protection of vital interests, or legitimate interests pursued by DigiPlus.

  1. Sharing and Disclosure of Personal Information

We may share your personal data with the following entities, for the purposes stated above, and as required by applicable laws and regulations:

  • Members of the Board of Directors and authorized officers of DigiPlus;
  • External professional advisors, such as legal counsel and auditors;
  • Regulatory and government authorities, as required by law or as necessary for the protection of our rights and interests;
  • Any court of law or administrative agency of the government exercising quasi-judicial powers, pursuant to a lawful order issued in relation to a pending case or proceeding before such court or agency;
  • Lenders or creditors of DigiPlus, underwriters, as well as the consultants, advisers or, auditors of the foregoing;
  • Duly authorized agents or representatives of stockholders;
  • Third-party service providers who act as data processors on our behalf and process personal data in accordance with our instructions and applicable data protection laws;
  • Any regulatory, quasi-judicial or judicial authority, or as otherwise considered necessary or appropriate by the Company for its legitimate business purposes;
  • Any other purpose analogous to the foregoing.
  1. Retention of Personal Information

The processing of your Personal Information will continue as may be necessary: (i) for the purposes stated herein; (ii) for the establishment, exercise or defense of legal claims; (iii) to fulfill requirements under the law, regulation or court order. If you request that you should not be able to access our services (i.e. self-exclude), we will retain this information for a minimum of five (5) years, from request, before permanent deletion.

  1. Security Measures

We implement reasonable and appropriate security measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. These measures include physical, technical, and organizational safeguards that comply with relevant industry standards and practices.

As a data subject, you have certain rights under the Philippine Data Privacy Act, including the right to access, correct, update, and delete your personal data. You may also have the right to object to the processing or request the restriction of your personal data.
